Legislation amendments
From July 1, 2022 the Federal Law No.64-FZ dated 05.04.2021 introduced the civil liability for non-compliance with the procedure for maintaining the Unified Federal Register of Travel Agents (the Register).
The Register is regulated by the Federal Law No.48-FZ dated 24.03.2021. This was reported in our publication from 11.05.2021.
Among the violations are:
- non-inclusion by the tour operator (travel agent) of information about the travel agent (subagent), promoting and implementing the tourist product created by the tour operator;
- inclusion of data about the travel agent (subagent) with violation of the prescribed procedure;
- inclusion of false data about the travel agent (subagent);
- the implementation of travel agency activity by a person who is not in the Register or without such a right;
- promotion and sale of the tourist product by the travel agent in the absence of information on conclusion of the agreement between him and the tour operator in the Register;
- transfer by the travel agent of the tour operator's order on promotion and sale of the tourist product in case the travel agent does not have such a right;
- promotion and sale of the tourist product by the subagent in the absence of information on conclusion of an agreement between him and the tour operator .
The following administrative fines were established: for officials - from 10 to 30 thousand rubles, for legal entities - from 50 to 100 thousand rubles.
The data on 32 thousand currently operating Russian travel agencies is available in the Information and Analytical system Globas. Since January 1, 2020, more than 7700 travel agencies are in the process of liquidation or have ceased operations.
Currently, the All-Russian Voluntary General Register of Travel Agencies of the Russian Union of Travel Industry contains 17507 companies and the Unified Federal Register of Tour Operators of the Federal Agency for Tourism contains 4249 companies.
